Email Lists: When a visitor submits a "Request Info" form on my website, is it fair to opt them in to my list?

I know that the best answer is to include an opt in check box on the form.

I'm not willing to do that, though.

My form is extremely simple. Take a look at it here:

http://www.heritage-education.com.

You can see the entire form and it's obvious that it will only take a minute to fill it out.

I don't want to add a check box because I feel that that would make people less likely to submit the form.

But, since they are requesting more info, it seems to me like it would be fair game to add them to my email list. I would, of course, give them an easy-to-use opt out option.

Thoughts?

I think it is very legitimate to add them to your email list.But, after sending them the follow up emails for more info.You can send them offers,which you think are genuine and not misleading.

Absolutely legit use of the opt in.

However, that doesn't mean opt ins want to be back sold to the grave so an occasional nudge is about all you should attempt. The weekly auto-responder will end up in the trash after a week or two so the opt-out is always a nice touch.

Good luck, but if the site visitor opted in, you can legally contact them because you now have a business relationship.
